This thread will be used in Paypal dispute as evidence against buyer claim for a full refund on a set of Buddy Club N+ Spec Dampers

I recently sold a used set of Buddy Club N+ Spec dampers to the user below. After days of the item being delivered as in same condition as shown in the pictures he wants to claim the item is not as described simply because it didn't included the adjustment spanners which he inquired about after making payment. I informed the buyer of the spanners having been stolen and I agreed to include some eBay spanners that did not work with the dampers with much convenience if he wanted them. The buyer never responded to this message to indicate that, so the spanners were not included. He was given ample time to read and respond to this message and never did so.

Timeline of messages and events with dates and times of each:

Negotiation Start January 23, 2011, 1:12 am
Payment "payment for buddy club coilovers" January 24, 2011, 12:09 pm
Message "does it come with spanner wrenches?" December 24, 2011, 12:09 pm
Message "The spanner wrenches got stolen out my tool box last summer." December 24, 2011, 1:21 pm
Shipped January 05, 2012, 3:51 pm, TROY, NY 12180
Delivered January 18, 2012, 10:31 am, POINT ROBERTS, WA 98281
Message "where is the spanner wrenches for your buddy club coilovers as you promised?" January 20, 2012, 12:03 am

I dont know if the buyer is confusing my last statement "I used some off an ebay coil set but those dont work very well I can included if you like." as the "promise" that the adjustment spanners where included but theres no reason for me to simply assume what the eBay spanners were wanted or expected because there was no response to my message explaining what the situation with the spanner were.

This is his claim: "this car part is missing adjustment tools and is not usable if not adjust properly"

I believe the above info resolves this for what it is.

I also have delivery confirmation number to verify delivery.

The ad is also in my signature without the pictures (which I still have) which doesn't not state anywhere that spanners are included.

My statement to Paypal:

"Buyer sent payment of $610.00 for "payment for buddy club coilovers". This is what has been delivered. Buyers claim is over items not explicitly agreed to before payment being received. Additionally no explicit agreement was reached even after payment was received. These items are claimed to have been promised but our communication throughout the negotiating promise says other wise. I have attached a link detailing the process of the transaction in which the items being claimed as "missing" are discussed and no agreement is made. I made the initiation of stating what I could do and the buyer made no attempt to respond in agreement and confirm the condition as a part of the sale.

I don't see why he is complaining. You can adjust them without the spanner wrenches.. just not as easily, and you sold them to him for $100 less then what you were asking.

Honestly this is goin on a lot lately. I had this happen twice in nov so left me broke for the holidays cause they put a hold on 1000+ dollars I had two people file not as described one for a set of toda b cams sai they Wer fake etc. he won cause they see it as buyer is in the right and guess what he got his money back and sent me a set of rusted to hell GSR cams an same happened with a set of pistons and eagle rods so by all means good luck with this bro its ashame how this all works out thieves are on the prowel.

Ive written multiple messages in the dispute message box and I ve PMd him here on HT. Id say if I dont hear from him I am going to put his name in the scammers list cause he has made no effort to resolve the situation.

That is absolutely ridiculous. I paid almost $1,000 from a user here on Honda-tech for some brand new koni/groundcontrol with extended tophats. He didn't include an adjustment wrench so I said okay, went to summitracing.com and bought one shipped to my house for 10 bucks.....

He's acting like he can't adjust them without the wrench, not only that but paying $100 less than you were asking he could spare $10 of it on an adjustment wrench if he needs it that badly.

he wont win this .... Paypal will never take money away if the sell was done out site of ebay. So money is your.... just provide them with proof of delivery and thats it.... you won

I did exactly that and still lost. But I contacted PayPal immediately and they have decided to re escalate the case for for another review.

They should be reading all of these comments so I don't know how the parties reviewing this case can ignore all of the evidence and comments. And I have yet to see a single price of evidence on the buyers part.

i' was in the exact same situation as your buyer.
i bought some used coilovers without wrenches and these bitches are tight.
its impossible to set these coilovers by hand and these coilovers are sitting too low. its garbage without wrenches

we re not arguing whether or not its easy to adjust them with out the tools. for many of us with mechanical knowledge there are other easy ways to adjust the coilover height. i adjusted them multiple times without the wrenches. the argument is that the tools he claims i promised were never listed as being included and the buyer was told that there were no tools for the coilovers and deserved no refund.

they gave me the run around for a while about holding the buyer responsible for returning the item.

they said the buyer would be given 3 or 10 days to return the item and he never and paypal didnt do anything.

dont really call back so i jus stopped using that account.

wish i had the time and money to sue paypal for enabling electronic fraud.

what a sissy, he got some good coilovers for 6 bills, alot better than d2 or f&f or any other susp in that price range. i got same set of coilovers and they did not come with wrenchs, i use some old **** ebay ones and they work fine. paypal is getting pretty sketchy, most times i have had claims like this i ended up losing and could not figure out how the hell they came to their conclusion.

side note i feel for dude that lost a set of toda cams for a rusted set of gsr's
